Vaporizers are an approved delivery method under the Texas Compassionate Use Program
If you have a qualifying condition, you may be eligible for a physician-prescribed device from a licensed Texas dispensary — evaluated entirely by telemedicine.

Effective September 1, 2025, the Texas Compassionate Use Program expanded to include chronic pain, traumatic brain injury (TBI), Crohn’s disease, terminal illness, hospice care, and palliative care — alongside the conditions that already qualified. HB 46 also authorized vaporization as a delivery method for the first time.
The law
Vaporization is legal in Texas — for TCUP patients
For most of TCUP’s history, Texas patients had one real option: swallow it. Tinctures, capsules, gummies. Effective, but slow — often 30 to 90 minutes before you feel anything.
House Bill 46 changed that. As of September 1, 2025, Texas law authorizes approved vaporizers as a delivery method under the Compassionate Use Program. Texas also moved from the old percentage-by-weight THC cap to dose-based limits, which is how medicine is actually measured.
Two things to understand before you book:
Vaporization has to be prescribed. It isn’t automatic — your physician determines whether it’s medically appropriate for your condition and, if so, writes it into your prescription along with your dose.
You buy from a licensed Texas dispensary. Texas Cannabis Clinic is a telemedicine clinic, not a dispensary. We certify you and enter your prescription in the state registry. The device and the product come from a TCUP-licensed dispensary.
If you lost your vape
Your hemp vape is gone. Here’s what’s left.
If you were buying THC or Delta-8 vapes at a Texas smoke shop, you’ve watched the shelves empty out over the last year.
- September 1, 2025Senate Bill 2024 makes selling any vape containing cannabinoids a Class A misdemeanor in Texas.
- March 31, 2026State rules end retail sales of smokable hemp, including flower and pre-rolls.
- July 31, 2026Delta-8, Delta-10, and other manufactured THC isomers become Schedule I controlled substances in Texas.
None of that touched TCUP.
The Compassionate Use Program is a separate legal framework — a physician-prescribed, state-registered, lab-tested pathway that operates under its own rules. If you have a qualifying condition, it is the legal route to vaporized cannabis in Texas today. It’s also a meaningful upgrade: known dosing, tested products, and a physician who knows your history instead of a label you have to take on faith.

Important distinction
Vaporizing and smoking are not the same thing under Texas law
This trips people up constantly, so it’s worth being direct: smokable cannabis flower remains illegal in Texas. There is no version of TCUP that lets you smoke.
What HB 46 authorized is vaporization through an approved device — heating the product rather than combusting plant material. Different mechanism, different legal status. Your dispensary will provide the device types your prescription permits.
⚠️ Worth knowing: products purchased outside a licensed Texas dispensary are not covered by your TCUP prescription, regardless of what’s in them.
Eligibility
Conditions that may qualify under TCUP
Eligibility always requires a physician evaluation — no condition is an automatic yes. But if any of these describe you, it’s worth two minutes to find out.

Texas doesn’t issue a physical card — here’s what you get instead
The State of Texas does not issue a physical medical marijuana card. Approved patients are enrolled in the CURT (Compassionate Use Registry of Texas) prescription registry, which is the official state record dispensaries check.
Texas Cannabis Clinic also provides every approved patient with a virtual certification card and approval letter through their patient portal — easy proof of your TCUP status whenever you need it.
Questions
Frequently asked questions
A 12-month TCUP certification with Texas Cannabis Clinic is $160, and as-needed video appointments are $75. That covers the physician evaluation, CURT registration, and twelve months of dose guidance. The device and product are purchased separately from a licensed Texas dispensary at dispensary pricing.
Most patients complete their appointment and receive a decision quickly — appointments are scheduled by telemedicine and handled in a single visit. Once you’re approved, your prescription is entered into the CURT registry and you can visit a licensed dispensary.
No. Your TCUP prescription covers products and devices obtained through a licensed Texas dispensary. Devices and cartridges bought at retail are outside the program regardless of what they contain, and cannabinoid vapes are no longer legal to sell at retail in Texas.
No — and the distinction matters. Smokable cannabis flower remains prohibited in Texas. HB 46 authorized vaporization through approved devices, which heats the product rather than burning plant material.
The qualifying conditions are the same for everyone, but PTSD and chronic pain — both of which qualify under TCUP — are common among veterans. Texas Cannabis Clinic is veteran-owned, and our physicians evaluate veterans by telemedicine statewide, including the military corridor from San Antonio to Killeen to El Paso.
