If you’ve been wondering whether Texas finally allows vaporizers for medical cannabis patients β the answer is yes. As of September 2025, vaporizers, inhalers, and nebulizers are now approved delivery methods under the Texas Compassionate Use Program (TCUP). That’s a big deal.
For years, TCUP patients were limited to tinctures and oils. Inhalation β one of the fastest-acting options available in states with mature medical programs β simply wasn’t on the table in Texas. Here’s what changed, what’s approved, and what it means for you.

1. What Changed β and Why It Matters
In June 2025, Governor Abbott signed House Bill 46 into law. It’s the biggest expansion of TCUP since the program launched in 2015, and one of its headline changes is simple: Texas patients can now legally inhale their medical cannabis through an approved vaporizer, inhaler, or nebulizer.
β οΈ Important: Smoking cannabis flower is still illegal in Texas. This applies to vaporized cannabis extracts only β not combustible plant material. TCUP has never authorized flower, and HB 46 doesn’t change that.
2. Which Vaporizers Are Approved in Texas?
Not just any device qualifies. Each one has to be submitted by a licensed TCUP dispensary and formally approved by the Texas Department of State Health Services (DSHS). As of early 2026, here’s the approved list:

3. What About the Hemp Vape Ban?
At the same time TCUP opened the door to vaporizers, Texas shut the door on hemp vapes in retail. Senate Bill 2024 banned the retail sale of cannabinoid vapes β including Delta-8, Delta-9, and THCA products β effective September 2025.
π TCUP patients are not affected by this ban. Your access through a licensed dispensary continues normally. But if you’ve been relying on retail hemp vapes and are looking for a legal alternative, qualifying for TCUP may be the path forward.
4. Do You Qualify?
HB 46 also expanded the list of qualifying conditions. You may qualify for TCUP if you’re living with any of the following:
- Chronic pain lasting more than 90 days β new under HB 46
- Traumatic brain injury (TBI) β new under HB 46
- Crohn’s disease β new under HB 46
- PTSD
- Epilepsy or seizure disorders
- Multiple sclerosis or spasticity
- ALS, autism, cancer, neuropathy, and other neurological conditions

Is vaping medical cannabis legal in Texas?
Yes β for TCUP patients only. HB 46 authorized approved vaporizers, inhalers, and nebulizers as delivery methods under the state medical cannabis program. Retail cannabinoid vapes remain banned. Smoking cannabis flower is still illegal in Texas under any circumstance.
My hemp vape was banned. Can I switch to TCUP instead?
If you have a qualifying condition, yes β TCUP is the legal path to inhalation in Texas now. You’d need to be evaluated by a licensed physician and enrolled in the program. TCUP products are lab-tested and physician-supervised, which is a meaningful upgrade from the retail hemp market.
How does my doctor prescribe a vaporizer specifically?
Your TCUP physician has to determine that inhalation is medically appropriate for your condition. If so, they prescribe it as your delivery method and specify the dosage. It’s not automatic β it depends on your condition and clinical judgment.
Do I get a card when I qualify?
